Your information matters — especially when it is about your fertility
Fertility information is deeply personal.
If you share information with Fertility Bandwidth about your fertility, health, cycles, pregnancy history, miscarriage, IVF, symptoms or wider wellbeing, we understand that you are trusting us with information you would not necessarily share widely.
So, before the legal detail, here are the important things to know:
We only collect information that we have a reason to use.
We do not sell your personal information.
We do not use your fertility or health answers to target you with advertising.
We do not give advertisers access to your Root Cause Assessment, fertility questionnaires, medical information or assessment results.
Where we ask you to share sensitive fertility or health information, we explain why we need it.
You can ask us what information we hold about you, ask us to correct it, and in many circumstances ask us to delete it.
Where we rely on your consent, you can withdraw that consent.
The rest of this policy explains exactly how that works.
1. Who we are
Fertility Bandwidth™ is operated by Karen Botha.
For UK data protection purposes, Fertility Bandwidth is the data controller for the personal information described in this Privacy Policy. This means we decide why and how that information is used.

This policy applies to our websites, forms, assessments, questionnaires, emails, booking pages, calls, programmes, client portals, digital products and other Fertility Bandwidth services.
2. The information we may collect
The information we collect depends on how you interact with us.
Basic personal and contact information
This may include:
your name;
email address;
telephone number;
country or location;
age or date of birth where relevant;
appointment and booking information;
payment and transaction information;
communications between you and Fertility Bandwidth.
Fertility and health information
Where you complete a fertility questionnaire, assessment, progress form or work with us directly, the information may be considerably more detailed.
This can include information about:
your fertility history;
menstrual cycle and ovulation;
pregnancy history;
miscarriage or pregnancy loss;
IVF, IUI or other fertility treatment;
AMH, hormone levels and other test results;
diagnosed or suspected health conditions;
reproductive and gynaecological history;
endometriosis, PCOS or other conditions;
symptoms;
medication;
supplements;
previous treatments or interventions;
digestive health;
immune or inflammatory symptoms;
nutrition;
sleep;
stress and emotional wellbeing;
lifestyle;
environmental exposure;
family or medical history;
information contained in medical reports or other documents you choose to provide;
information about your partner where relevant to your fertility circumstances.
Depending on what you tell us, some information may also reveal information about sexual or reproductive health.
Under UK data protection law, information concerning health is classed as special category personal data and receives additional legal protection. We treat fertility and reproductive information accordingly.
3. Why we ask about your fertility and wider health
Fertility rarely exists in isolation from the rest of a person's history.
Where you ask Fertility Bandwidth to assess or help you understand your circumstances, we may therefore need information beyond whether you are currently trying to conceive.
For example, information about previous pregnancies, treatment, symptoms, digestion, sleep, nutrition, medication or existing medical findings may be relevant to understanding the wider picture you have asked us to consider.
We use this information to:
review information you have chosen to provide;
assess whether our service may be appropriate for you;
carry out a Root Cause Assessment where purchased;
identify patterns and areas that may deserve further consideration;
prepare for appointments;
personalise educational or programme support;
monitor progress where you are receiving ongoing support;
communicate with you about the service you have requested;
maintain appropriate records of our work together.
We do not collect fertility or health information simply because it may be interesting or useful for marketing.
4. Our lawful reasons for using your information
UK data protection law requires us to have a lawful reason for processing personal information.
Different reasons apply to different activities.
When you enquire, book or request something from us
We may process ordinary personal information because it is necessary to take steps at your request before entering into a contract or to provide something you have requested.
Lawful basis: contract or steps before entering into a contract.
When you purchase a service or programme
We use information necessary to provide the product, assessment, programme or support you purchased.

When you provide fertility or health information
Health information is special category data.
Where required, we rely on your explicit consent to process fertility, reproductive and health information for the specific service or assessment you have requested.
Our ordinary lawful basis for the associated processing will usually be contract, steps taken at your request before a contract, or legitimate interests where appropriate.
Our special category condition will normally be:
Article 9(2)(a) UK GDPR — explicit consent.
In limited circumstances, we may also need to retain or use particular information where necessary to establish, exercise or defend legal claims.
Administration, security and running the business
We may process appropriate information to:
administer our business;
keep appropriate records;
prevent misuse or fraud;
maintain website and system security;
investigate technical problems;
protect our legal rights;
improve how our services operate.
Lawful basis: our legitimate interests, where those interests are not overridden by your rights.
Legal, accounting and tax requirements
We may retain information where UK law requires us to do so.

Marketing
Where you have asked to receive fertility education, updates, offers or other marketing, we may use your contact information to send it.
Depending on the circumstances, we rely on:
your consent; or
the limited "soft opt-in" permitted under UK electronic marketing law for similar products or services where its requirements are met.
You can unsubscribe at any time.
Unsubscribing from marketing does not prevent us sending essential messages about an appointment, purchase or service you have requested.
Analytics and advertising measurement
Where consent is required for cookies, pixels or similar tracking technologies, we rely on that consent before using them.
This is separate from the consent you may give us to process health information.
5. Explicit consent for fertility and health information
Because fertility and health information can be particularly sensitive, we may ask you to give an express statement of consent before submitting it.
That consent will be separate from any optional marketing consent.
Giving us permission to process your health information does not automatically subscribe you to marketing.
Where your fertility or health information is necessary for the service you have requested, choosing not to provide it may mean that we cannot properly carry out that assessment or service.
You can withdraw consent where we rely on consent.

Withdrawal does not make processing that has already lawfully taken place invalid.
Depending on what you withdraw consent from, we may no longer be able to continue an assessment or service that depends on the information.
We may also be legally entitled or required to retain limited information despite withdrawal — for example, financial records or information genuinely required for legal claims. Where that applies, we will no longer use the information for purposes that depend upon your consent.
6. Who may process information for us
We use specialist technology providers to operate Fertility Bandwidth.
Depending on the service or page you use, these can include:
HighLevel / LeadConnector
Used for services including:
website and funnel functionality;
forms and questionnaires;
customer relationship management;
booking systems;
automated communications;
email and SMS delivery;
workflows;
programme or membership access;
client portal functionality.
Google services may be used for:
business email through Google Workspace/Gmail;
calendar management;
file and document administration;
website analytics where enabled;
embedded or hosted video through YouTube.
Stripe
Stripe is used to process payments.
We do not normally receive or store your complete payment card details. Payment information is processed through the payment provider.
Meta
Meta services, including Facebook and Instagram technology, may be used for:
advertising;
understanding advertising performance;
measuring whether an advertisement resulted in a website visit, registration or other conversion.
Advertising measurement is explained separately below because it is not the same thing as providing your fertility service.
Website analytics and tracking providers
We may use analytics, tag-management and similar technology to understand matters such as:
how visitors reach our website;
which pages are used;
whether pages work properly;
broad website performance;
advertising conversions.
Non-essential tracking is controlled in accordance with applicable cookie and electronic communications law.
Video platforms
Videos may be hosted or embedded using services such as YouTube.
When you interact with an embedded service, that provider may collect information under its own privacy terms.
Client and programme platforms
Where you access digital training, resources, questionnaires or client support through a portal, the platform providing that service may process the information required to give you access.
AI-assisted software
We may use AI-assisted software or similar digital tools to support administrative work such as organising information, summarising notes, structuring documents or preparing materials.
Where identifiable personal information is involved, we aim to minimise the information provided and use appropriate privacy and security controls.
AI tools do not diagnose you, determine your medical treatment, decide whether you can become pregnant or make solely automated decisions about your eligibility for Fertility Bandwidth services.
Human judgement remains involved in our work.
We do not authorise our technology providers to use your information for their own unrelated advertising simply because they provide technology to us.
Some providers may also process limited information as independent controllers for their own legal, security or operational purposes. Their own privacy policies explain those activities.
7. Service delivery is different from advertising
This distinction is particularly important to us.
Service delivery
Service information can include things such as:
your name and contact details;
fertility questionnaires;
Root Cause Assessment information;
health and symptom information;
assessment results;
progress forms;
emails;
appointment notes;
programme information.
We use this because you have asked us to provide something to you.
Advertising and measurement
Advertising technology may process more limited information such as:
that someone visited a page;
device or browser information;
IP address;
cookie or advertising identifiers;
that a registration or purchase occurred;
broad advertising attribution information.
Where the law requires consent for this technology, it will not be activated until appropriate consent has been obtained.
What we do not do
We do not intentionally provide your fertility questionnaire answers, medical information, Root Cause Assessment answers, miscarriage history, IVF history, diagnoses, test results or assessment conclusions to advertising platforms for personalised advertising.
We do not use specific health conditions or Root Cause Assessment findings to create advertising audiences targeted around your individual health circumstances.
We do not sell your fertility information to advertisers.
8. Cookies, pixels and similar technology
Our websites may use:
essential cookies;
analytics cookies;
advertising cookies;
tracking pixels;
tags;
scripts or similar technologies.
Some are necessary for the website to function.
Others help us understand website use or advertising performance.
Where UK law requires permission before those technologies are used, you will be given an appropriate choice.
You can change or withdraw your cookie preferences where the relevant controls are available.
Rejecting non-essential tracking should not prevent you from accessing the core information on our website.

9. Emails and communications
If you ask us for information, register for something, book an appointment or purchase a service, we may send communications necessary to respond to or deliver that request.
These are service communications, not marketing.
Separately, we may send educational content, updates and offers where we have a lawful basis to do so under UK data protection and electronic marketing law.
Every marketing email will provide a way to unsubscribe.

10. International transfers
Some of the technology providers used by Fertility Bandwidth operate internationally, including in the United States and other countries outside the United Kingdom.
This means that personal information may sometimes be processed or stored outside the UK.
Where UK data protection law classifies this as a restricted international transfer, we take reasonable steps to ensure that an appropriate legal safeguard is in place.
Depending on the provider and destination, this may include:
a UK adequacy regulation;
the UK International Data Transfer Agreement;
the UK Addendum to approved Standard Contractual Clauses;
another safeguard permitted by UK data protection law.

11. How long we keep information
We do not want to keep sensitive fertility information indefinitely simply because we once collected it.
How long we retain information depends on why we have it.
As a general guide:
Fertility or health forms where you do not become a client
We will normally retain identifiable fertility or health information for up to 12 months after your last meaningful interaction with us, unless there is a reason to retain it for longer or you ask for it to be deleted earlier and we are able to do so.
Client assessments and programme records
Where you purchase an assessment, programme or ongoing support, relevant records may normally be retained for up to six years after our working relationship ends where reasonably necessary for service history, administration and the establishment, exercise or defence of legal claims.
We may delete or anonymise information earlier where it is no longer needed.
General enquiries
Information relating to an enquiry where no client relationship develops will normally be reviewed for deletion within 24 months of the last meaningful contact.
Financial and transaction records
Invoices, transaction records and other accounting information are retained for the period required by applicable UK tax, accounting and legal requirements, which may be several years.
Marketing records
We keep marketing information while you remain subscribed or while we otherwise have a lawful basis to contact you.
We periodically review inactive marketing information.
If you unsubscribe, we may retain the minimum information necessary to ensure that your opt-out continues to be respected.
Website analytics
Retention periods depend on the analytics technology being used and our configuration of that technology.
Aggregated or genuinely anonymised information that no longer identifies you may be retained for longer.
These are our normal retention periods rather than an absolute promise that every individual record will be deleted on exactly the same day. We regularly review what information is still required and should delete or anonymise information that no longer has a legitimate purpose.
12. Information about your partner
Fertility often involves two people.
You may therefore choose to tell us information about your partner, including information about their fertility or health.
Please only provide another person's personal or health information where you are entitled to do so and, where appropriate, make them aware that you are providing it.
If we need substantial identifiable health information directly about your partner, we may ask them to provide information themselves and/or provide their own explicit consent.
Where applicable, we will provide appropriate privacy information to them.
13. Calls, recordings and transcripts
Appointments may sometimes take place through telephone, video-conferencing or other online communication services.
If a call is going to be recorded or transcribed, we will tell you.
Recordings or transcripts may be used where appropriate to:
maintain accurate records;
prepare notes;
review information discussed;
support the service you have requested;
improve internal service quality.
They will not be secretly converted into advertising material.
Where consent is required for a particular recording or use, we will ask for it.
14. Testimonials and success stories
We will not treat the fact that you bought a service as permission to publicly share your fertility story.
If we want to use a testimonial, case study, photograph or other identifiable success story, we will obtain appropriate permission.
Where the testimonial reveals health or fertility information, additional explicit consent may be required.
You can withdraw consent for future use where the processing is based on consent, although withdrawal cannot always reverse material that was lawfully published before withdrawal.
15. How we protect your information
We use reasonable technical and organisational measures designed to protect personal information against:
unauthorised access;
accidental loss;
inappropriate disclosure;
alteration;
destruction or misuse.
Access to sensitive information should be limited to those who genuinely need it.
No internet-based service can promise absolute security, but the sensitivity of fertility and health information is taken into account when choosing how information is stored and handled.
16. Your rights
Depending on the circumstances, UK data protection law may give you the right to:
ask what personal information we hold about you;
receive a copy of your personal information;
correct inaccurate information;
complete incomplete information;
ask us to delete information;
ask us to restrict how information is used;
object to certain processing;
receive certain information in a portable format;

Not every right applies in every situation.

19. Withdrawing consent
Where we rely on your consent, withdrawing it is designed to be straightforward.

20. Automated decision-making
We do not use automated systems to make legally significant decisions about you without meaningful human involvement.
A questionnaire may use conditional logic — for example, showing different questions or information depending on an answer you choose.
That does not mean a computer is diagnosing you.
Automated form routing or scoring may help organise information, but important assessments and recommendations are not intended to be based solely on automated decision-making.
21. Children
Fertility Bandwidth services are intended for adults.
We do not knowingly invite children to submit detailed fertility or health information through our adult services.

22. Links and external websites
Our website, emails or programmes may link to other websites or services.
Once you leave a Fertility Bandwidth service, another organisation may be responsible for how it processes your information.
We recommend reviewing the privacy information provided by that organisation where appropriate.
23. Complaints
If you are unhappy about how we have handled your personal information, we would prefer the opportunity to resolve it directly.
